Welcome to SkillClaimed! These Terms of Use ("Terms") govern your access to and use of the SkillClaimed platform, including our website, digital badge issuance, and related services (collectively, the "Services"). By using SkillClaimed, you agree to these Terms. If you do not agree, you should not use our Services.

 

1. Overview of Services

SkillClaimed provides a platform for individuals and organizations to claim, issue, and display digital credentials (Open Badges) that represent skills, achievements, or experiences.

1.1. Individual Users

Users can claim skill-based badges by self-attesting to their knowledge and experience. These badges may be shared on social platforms like LinkedIn, resumes, and other professional profiles.

1.2. Corporate Users

Organizations can issue badges to employees, trainees, or affiliates based on predefined internal criteria. The organization assumes responsibility for verifying the validity of issued badges.

 

2. Eligibility & Account Registration

2.1. Who Can Use SkillClaimed?

You must be at least 18 years old to use our Services. By registering, you confirm that you have the legal capacity to enter into this agreement.

2.2. Account Security

  • You are responsible for maintaining the security of your account.
  • Do not share your login credentials with anyone.
  • You agree to notify us immediately if you suspect unauthorized access to your account.

3. Use of Digital Badges

3.1. Self-Claimed Badges

  • SkillClaimed operates on an honor-based system, meaning users self-claim their expertise.
  • We do not independently verify the skills claimed by individuals.
  • Employers, recruiters, and third parties should assess badges as supplementary credentials rather than formal certifications.

3.2. Corporate-Issued Badges

  • Companies using SkillClaimed for internal credentialing are responsible for ensuring badges are issued based on valid criteria.
  • SkillClaimed is not liable for misrepresentation of corporate-issued badges.

3.3. Badge Display & Use

  • You may display SkillClaimed badges on LinkedIn, social media, resumes, and job applications.
  • You may not alter, forge, or misrepresent any badge issued through SkillClaimed.
  • Badges may be revoked in cases of fraud, misrepresentation, or policy violations.

4. Payment & Refund Policy

4.1. Pricing & Transactions

  • SkillClaimed offers paid digital badges and corporate subscription plans.
  • Prices are listed on our website and are subject to change.

4.2. Refunds

  • Refunds are not available for claimed badges.
  • Refunds for corporate licenses may be issued under exceptional circumstances at SkillClaimed’s discretion.

5. Intellectual Property Rights

5.1. Ownership of Badges & Platform

  • SkillClaimed retains all intellectual property rights in the platform, including its branding, badges, and technology.
  • Users and organizations do not own the badge design, technology, or issuance system—only the right to display their issued badge.

5.2. User-Generated Content

  • By claiming a badge, you grant SkillClaimed a non-exclusive, worldwide license to use, display, and distribute your badge data for verification and marketing purposes.
  • You may request removal of your badge display from our public records by contacting our support team.

6. Prohibited Activities

You agree not to:

  • Provide false or misleading information when claiming a badge.
  • Use SkillClaimed for fraudulent, illegal, or deceptive purposes.
  • Modify, duplicate, or sell SkillClaimed badges outside of the platform.
  • Violate the intellectual property rights of SkillClaimed or third parties.
  • Interfere with or disrupt SkillClaimed’s technology, security, or services.

Violation of these Terms may result in badge revocation, account suspension, and legal action.

7. Disclaimers & Limitation of Liability

7.1. No Guarantee of Employment

SkillClaimed provides digital credentials but does not guarantee employment, career advancement, or job offers based on the use of our Services.

7.2. Platform Availability

SkillClaimed is provided on an “as-is” basis. We do not warrant that the platform will be error-free, uninterrupted, or free of security vulnerabilities.

7.3. Liability Limitation

To the fullest extent permitted by law, SkillClaimed is not liable for:

  • Any errors, omissions, or inaccuracies in badge issuance.
  • Any losses, damages, or employment consequences from the use of SkillClaimed badges.
  • Any data loss, security breaches, or service interruptions.

Total liability under these Terms shall not exceed the amount you paid for SkillClaimed services in the past 12 months.

8. Badge Revocation & Account Termination

SkillClaimed reserves the right to:

  • Revoke badges in cases of fraud, false claims, or misrepresentation.
  • Suspend or terminate accounts violating our Terms.
  • Modify or discontinue the SkillClaimed platform at any time.

Users may request account deletion by contacting customer support.

9. Governing Law & Dispute Resolution

9.1. Jurisdiction

These Terms are governed by the laws of the State of Florida, USA.

9.2. Dispute Resolution

Any disputes arising from these Terms shall be resolved through arbitration in Florida, unless otherwise required by law.

10. Changes to These Terms

SkillClaimed reserves the right to update these Terms at any time. Changes will be communicated via:

  • Email notifications (for registered users).
  • A public notice on our website.

Your continued use of SkillClaimed after changes take effect constitutes acceptance of the revised Terms.
